Welcome to the website (the “Site”) of Rent Right (“Rent Right,” “we,” “us,” or “our”). Rent Right makes available flexible occupancy accommodations of furnished residential apartment units (each a “Unit,” and the building in which such Unit is located may be referred to as the “Building”) in multi-family apartment properties (“Accommodations”) for its registered users (“Tenants”) on the terms and conditions provided in our Terms of Service (collectively, including the Site, the “Service”).

This Privacy Policy explains what Personal Data (defined below) we collect, how we use and share that data, and your choices concerning our data practices. This Privacy Policy is incorporated into and forms part of our Terms of Service.

Before using the Service or submitting any Personal Data to Rent Right, please review this Privacy Policy carefully and contact us if you have any questions. By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access the Site or otherwise use the Service.

Capitalized terms used without definition in this Privacy Policy have the meanings set forth in our Terms of Service.

1. PERSONAL DATA WE COLLECT

Information Needed to Use the Rent Right Platform. We collect personal information about you when you use the Rent Right Platform. Without it, we may not be able to provide all services requested. This information includes:

  • Contact, Account, and Profile Information. Such as your first name, last name, phone number, postal address, email address, date of birth, and profile photo, some of which will depend on the features you use.
  • Identity Information. Where appropriate, we may ask you for an image of your government-issued ID (in accordance with applicable laws) or other verification information, and/or a selfie when we verify your ID. If a copy of your ID is provided to us, we will obtain information from your ID. See our Help Center article on Verifying your identity.
  • Payment Information. Such as payment account or bank account information. If you are not an Rent Right user, we may receive payment information relating to you, such as when an Rent Right user provides your payment card to complete a booking. See our Help Center article on Paying and getting paid on behalf of someone else.

Information You Choose to Give Us. You can choose to provide us with additional personal information, including:

  • Additional Profile Information. Such as gender, preferred language(s), city, and personal description.
  • Information About Others. Such as a payment instrument or contact information belonging to another person or information about a co-traveler. By providing us with personal information about others, you certify that you have permission to provide that information to Rent Right for the purposes described in this Privacy Policy and you have shared the Rent Right Privacy Policy with them.
  • Biometric Information. Such as facial recognition data derived from photos and identification documents you submit for verification, where offered and with your consent where required by applicable law.
  • Other Information. Such as when you fill in a form, add information to your account, respond to surveys, post to community forums, participate in promotions, communicate with Rent Right Support and other Members, import or manually enter address book contacts, provide your address and/or geolocation, or share your experience with us. This may include health information if you choose to share it with us.

Information Automatically Collected by Using the Rent Right Platform and Our Payment Services. When you use the Rent Right Platform and Payment Services, we automatically collect certain information. This information may include:

  • Geolocation Information. Such as precise or approximate location determined from your IP address, mobile or other device’s GPS, or other information you share with us, depending on your device settings. We may also collect this information when you’re not using the app if you enable this through your settings or device permissions.
  • Usage Information. Such as searches for Listings, bookings you have made, additional services you have added, access dates and times, the pages you’ve viewed or engaged with before or after using the Rent Right Platform, and other actions on the Rent Right Platform, including the pages or content you view and links you click to third-party applications. We may collect this information even if you haven’t created an Rent Right account or logged in.
  • Device Information. Such as IP address, hardware and software information, device information, device event information, unique identifiers, crash data, and read receipts. We may collect this information even if you haven’t created an Rent Right account or logged in.
  • Cookies and Similar Technologies As Described in Our Cookie Policy.
  • Payment Transaction Information. Such as payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, PayPal email address, IBAN information, your address, and other related transaction details.

Information We Collect from Third Parties. We may collect personal information from other sources, such as:

  • Third-Party Applications. If you choose to link, connect, or login to the Rent Right Platform with a third-party service, such as Google, Facebook, and WeChat, you direct the service to send us information such as your registration, friends list, and profile information as controlled by that service or as authorized by you via your privacy settings at that service. If you choose to connect a smart lock to your Rent Right account, we may collect information about the smart device, such as log or event information and device information.
  • Background Information Providers. For Members in the United States, To the extent permitted by applicable laws, we may obtain, for example, reports of criminal records, sex offender registrations, and other information about you and/or your background. For Hosts in India, to the extent permitted by applicable laws, we may perform criminal background checks. For Members outside of the United States, to the extent permitted by applicable laws and with your consent where required, we may obtain police, background, or registered sex offender checks. We may use your information, including your full name and date of birth, to obtain such reports.
  • Enterprise Product Invitations and Account Management. Organizations that use our Enterprise products may submit personal information to facilitate account management and invitations to use enterprise products.
  • Referrals and Co-Travelers. If you are invited to the Rent Right Platform, for example, as a co-traveler on a trip, the person who invited you can submit personal information about you.
  • Guest Travel Insurance Partners. If you make a claim under a Guest Travel Insurance Policy, we may receive information regarding your claim in order to provide you with customer service and improve our platform.
  • Complainants. If a Host, Guest, or any third party submits a complaint about you, we may receive information relating to the specific complaint made in order to understand and, where relevant, address the complaint.
  • Financial Institutions. If you elect to pay with funds from your bank account, we may receive certain information from your financial institution, such as bank account details and account balance.
  • Flexible Payment Plans and Financing Providers. If you elect to purchase a reservation and pay on an installment plan, we may receive certain information from the third-party provider, such as the payment schedule and actual payments on authorized payment plans.
  • Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as references, demographic data, and information to help detect fraud and safety issues from (i) third-party service providers, other third parties, and/or partners, or (ii) Members and any other individuals, entities, and authorities, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from identity verification service providers for use in our fraud prevention, security investigation, and risk assessment efforts. We may receive information about you and your activities on and off the Rent Right Platform, including from users of Rent Right, members of the public, or governmental, public, or tax authorities, or about your experiences and interactions from our partners. We may receive health information including, but not limited to, health information related to contagious diseases.

2. HOW WE USE PERSONAL DATA

We may use Personal Data for the following purposes:

  • To operate, provide, and maintain our Services, to communicate with you about our Services, to respond to your inquiries, to fulfill our contract with you, to complete your transactions, and for other customer service purposes;
  • To run background and credit checks to determine whether we may reasonably admit you as a Tenant and allow you to book Accommodations, the results of which may be shared with of landlords and their representatives (e.g., property managers), to the extent permitted under applicable law;
  • To link your Rent Right account with Third Party Accounts to add information from Third Party Accounts to your Rent Right account and Rent Right account profile page. Depending on the Third Party Accounts you choose and subject to the privacy settings that you have set in such Third Party Accounts, you understand that by granting us access to the Third Party Accounts, we will access, make available and store (if applicable and as permitted by the SNS and authorized by you) the information in your Third Party Accounts so that it is available on and through your Rent Right account on the Site and Service;
  • To respond to your inquiries, comments, feedback or questions;
  • To send administrative information to you, for example, information regarding the Service, and changes to our terms, conditions, and policies;
  • To analyze how you interact with our Service;
  • To prevent fraud, criminal activity, or misuses of our Service, and to ensure the security of our IT systems, architecture and networks; and
  • To comply with legal obligations and legal process and to protect our rights, privacy, safety or property, and/or that of our affiliates, you or other third parties.


Aggregated Information.: We may aggregate Personal Data and use the aggregated information to analyze the effectiveness of our Service, to improve and add features to our Service, and for other similar purposes. In addition, from time to time, we may analyze the general behavior and characteristics of users of our Services and share aggregated information like general user statistics with prospective business partners. We may collect aggregated information through the Service, through cookies, and through other means described in this Privacy Policy.

Marketing: We may use your Personal Data to contact you to tell you about products or services we believe may be of interest to you. For instance, if you elect to provide your email or telephone number, we may use that information to send you special offers. You may opt out of receiving emails by following the instructions contained in each promotional email we send you. In addition, if at any time you do not wish to receive future marketing communications, you may contact us. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding management of your account, other administrative matters, and to respond to your requests.

3. SHARING AND DISCLOSURE OF PERSONAL DATA

In certain circumstances we may share your Personal Data with third parties without further notice to you, unless required by the law, as set forth in Section 2 above and as follows:
Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Data with vendors and service providers, including providers of hosting services, cloud services and other information technology services providers, email communication software and email newsletter services, advertising and marketing services, payment processors, customer relationship management and customer support services, and web analytics services (for more details on the third parties that place cookies through the Site, please see the “Cookies” section above). Pursuant to our instructions, these parties will access, process or store Personal Data in the course of performing their duties to us. Landlords and property managers. We may share your name, email address, phone number, ID, birthday and address with landlords and their representatives (e.g., property managers). If permitted by applicable law, we may also share information from background checks and credit checks that we conduct. We may share reports with landlords and property managers regarding the use of their properties.

Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your Personal Data and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction along with other assets.
Legal Requirements: If required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Services, or the public, or (v) protect against legal liability.
Affiliates: We may share Personal Data with our affiliates, meaning an entity that controls, is controlled by, or is under common control with Company. Our affiliates may use the Personal Data we share in a manner consistent with this Privacy Policy.

4. DATA RETENTION

We keep Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a business need to do so, or as required by law (e.g. for tax, legal, accounting or other purposes), whichever is the longer.

5. UPDATE / DELETE YOUR INFORMATION

Please log in to your account or contact us at rentrightoday@gmail.com if you need to change or correct your Personal Data. If you wish to request to have your Personal Data deleted off our Platform, please contact us at rentrightoday@gmail.com.

6. CALIFORNIA PRIVACY RIGHTS DISCLOSURES

California Civil Code Section § 1798.83 permits users of our Site that are California residents to request the categories of Personal Data we disclosed to third parties for their direct marketing purposes in the year preceding the request, the names and addresses of such third parties, and, in certain circumstances, examples of the products or services marketed by such third parties. 7. CHILDREN

Our Service is not directed to children who are under the age of 13. Rent Right does not knowingly collect Personal Data from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Data to Rent Right through the Service, please contact us and we will endeavor to delete that information from our databases.

8. LINKS TO OTHER WEBSITES

The Site may contain links to other websites not operated or controlled by Rent Right, including social media services (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third-Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third-Party Sites directly for information on their privacy practices and policies.

9. SECURITY

You use the Service at your own risk. We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Data both online and offline from loss, misuse, and unauthorized access, disclosure, alteration or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or e-mail. Please keep this in mind when disclosing any Personal Data to Rent Right via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third-party websites.

10. INTERNAL USERS

By using our Service, you understand and acknowledge that your Personal Data will be transferred from your location to the facilities and servers of Company in the United States.

11. YOUR CHOICES AND RIGHTS

In certain circumstances providing Personal Data is optional. However, if you choose not to provide Personal Data that is needed to use some features of our Services, you may be unable to use those features. You can also contact us to ask us to update or correct your Personal Data.

Under the conditions of Article 21 (1) GDPR, data processing can be objected to on grounds relating to the particular situation of the data subject.

The above general right of objection applies to all processing purposes described in this Privacy Policy which are based on Article 6 (1) (f) GDPR. Unlike the special right of objection to data processing for advertising purposes, under the GDPR we are only obliged to implement such a general objection if you give us reasons of overriding importance for this (for example, possible danger to life or health). In addition, you may also contact the supervisory authority responsible for Rent Right.

In case the California Consumer Privacy Act (“CCPA”) applies, you are entitled to the following rights:

Right to request deletion under certain circumstances

If you exercise your access right in a verified way, we will disclose the following information in a portable and (if technically feasible) readily usable form to you: categories of personal information collected, categories of sources for that information, business or commercial purpose for the collection, categories of third parties with whom we share the information, and the specific pieces of personal information we collected on you.

We do not sell (as such term is defined in the CCPA) personal information and will not sell it without providing a right to opt out.

Please note that we use third-party cookies for advertising purposes and may share personal information with third parties for business purposes as further described above in this Privacy Policy.

We will not discriminate against you for exercising the rights under CCPA. In particular, we will not, deny you goods or services, charge you different prices for goods or services, whether through denying benefits or imposing penalties, provide you with a different level or quality of goods or services, and/or threaten you with any of the above.

As a California resident you may make a request and exercise your rights under CCPA by contacting us at the email address or telephone number indicated at the top of this page (in our imprint). Please provide sufficient information that allows us to reasonably verify that you are either the person on whom we collected personal information or an authorized representative of that person.

We may have collected the following categories of personal information on California residents in the past 12 months:

12. CHANGES TO THE PRIVACY POLICY

The Service, and our business may change from time to time. As a result, we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by the applicable law. By continuing to use our Service or providing us with Personal Data after we have posted an updated Privacy Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy and practices described in it.
